6.1    To be eligible for an account on our website under this Section 6, you must be resident or situated in the United Kingdom.

6.2    You may register for an account with our website by completing and submitting the account registration form on our website, and clicking on the verification link in the email that the website will send to you.

6.3    You must not allow any other person to use your account to access the website.

6.4    You must notify us in writing immediately if you become aware of any unauthorised use of your account.

6.5    You must not use any other person's account to access the website, unless you have that person's express permission to do so.

7.      User login details

7.1    If you register for an account with our website, you will be asked to choose a user ID and password.

8.      Cancellation and suspension of account

8.1    We may:

(a)    edit your account details;

(b)    temporarily suspend your account; and/or

(c)    cancel your account,

        at any time in our sole discretion, providing that if we cancel any services you have paid for and you have not breached these terms and conditions, you will be entitled to a refund of any amounts paid to us in respect of those services that were to be provided by us to you after the date of such cancellation; we will give you reasonable written notice of any cancellation under this Section 8.1.

8.2    You may cancel your account on our website by sending e-mail at contact@netalkers.com. You will not be entitled to any refund if you cancel your account in accordance with this Section 8.2.

9.      Promotion at our website

9.1    We welcome the postings for Promotion at our website.

9.2    You may post your promotions at PROMOTION under MY PAGE after sign in.

9.3    You will have the opportunity to correct input errors throughout the posting period.

9.4    Promotion postings submitted to our website must constitute bona fide promotions that are true, fair and accurate in all respects.

9.5    Promotion postings must be listed in the appropriate category or categories.

9.6    Promotion postings submitted to our website must not be for any product, service or other subject matter that:

(a)    breaches any laws, regulations or codes;

(b)    infringes any third party intellectual property rights or other legal rights; or

(c)    may give rise to a cause of action against any person,

         in each case in any jurisdiction and under any applicable law.

9.7    Promotion postings submitted to our website must not be for any product, service or other subject matter that:  

(a)    consists of or contains material that would, if published on our website by you, contravene the provisions of Section 13; or

(b)    is or relates to:

(i)    drugs, narcotics, steroids or controlled substances;

(ii)    obscene, indecent, pornographic or sexually explicit materials;

(iii)   knives, swords, firearms or other weapons;

(iv)   ammunition for any weapon;

(v)    items that encourage or facilitate criminal acts or civil wrongs; or

(vi)   items that encourage or facilitate the infringement of any intellectual property right.

9.8    Your Promotion postings must comply with the requirements of Section 4 and Section 13.

9.9    You grant to us a worldwide, non-exclusive, royalty-free licence to publish your Promotion postings on our website, and to copy, alter and store your advertisements in connection with their publication on our website, together with the right to sub-license these rights.

9.10  You must keep your Promotion postings up to date using our website interface, and must delete or unpublish any Promotion postings that have ceased to be relevant to our users (for example, because products advertised are no longer available). 

9.11  Promotion postings submitted to our website will be automatically processed, and will usually be published within 24 hours following submission; however, we do not guarantee publication within this period.

9.12  Without prejudice to our other rights under these terms and conditions, we reserve the rights to reject, unpublish or delete Promotion postings that breach these terms and conditions or that do not meet any additional guidelines for submissions published on our website. If we reject, unpublish or delete an advertisement in accordance with this Section 9.12, we will not refund any applicable listing fees.

9.13  If we accept your Promotion postings submission, then it will remain published on our website for a period of 30 days, subject to these terms and conditions.

9.14  From time to time we may allow the publication of Promotion on our website free of charge, providing that free Promotion postings will be subject to such additional terms and conditions as we may specify from time to time, and we may delete free Promotion postings at any time in our sole discretion with or without notice to you. 

10.    Fees

10.1  The fees in respect of our website services will be as set out on the website from time to time.

10.2  All amounts stated in these terms and conditions or on our website are stated exclusive of VAT.

10.3  You must pay to us the fees in respect of our website services in advance, in cleared funds, in accordance with any instructions on our website.

10.4  We may vary fees from time to time by posting new fees on our website, but this will not affect fees for services that have been previously paid.

10.5  If you dispute any payment made to us, you must contact us immediately and provide full details of your claim.

10.6  If you make an unjustified credit card, debit card or other charge-back then you will be liable to pay us, within 7 days following the date of our written request:

(a)    an amount equal to the amount of the charge-back;

(b)    all third party expenses incurred by us in relation to the charge-back (including charges made by our or your bank or payment processor or card issuer);

(c)    an administration fee of GBP 25.00 including VAT; and

(d)    all our reasonable costs, losses and expenses incurred in recovering the amounts referred to in this Section 10.6 (including without limitation legal fees and debt collection fees),

        and for the avoidance of doubt, if you fail to recognise or fail to remember the source of an entry on your card statement or other financial statement, and make a charge-back as a result, this will constitute an unjustified charge-back for the purposes of this Section 10.6.

10.7  If you owe us any amount under or relating to these terms and conditions, we may suspend or withdraw the provision of services to you.

10.8  We may at any time set off any amount that you owe to us against any amount that we owe to you, by sending you written notice of the set-off.

11.    Cancellation and refund

11.1  This Section 11 applies when you purchased Promotion services (“the services”) at our website.

11.2  You may cancel the services you purchased through our website, at any time within the period:

(a)    beginning upon the purchase of the services; and

(b)    ending at the end of 14 days after the day on which the services are purchased,

(c)    however, you will be charged for the services you use within the 14 days on a pro-rata basis   

        subject to Section 11.3. You do not have to give any reason for your withdrawal or cancellation.

11.3  You agree that we may begin the provision of services before the expiry of the period referred to in Section 11.2, and you acknowledge that, if we do begin the provision of services before the end of that period, then:

(a)    if the services are fully performed, you will lose the right to cancel referred to in Section 11.2;

(b)    if the services are partially performed at the time of cancellation, you must pay to us an amount proportional to the services supplied or we may deduct such amount from any refund due to you in accordance with this Section 11.

11.4  In order to withdraw or cancel the services on the basis described in this Section 11, you must inform us of your decision to withdraw or cancel (as the case may be). In the case of cancellation, inform us by e-mail at refund@netalkers.com or click Cancel Order button under My payment. To meet the cancellation deadline, it is sufficient for you to send your communication concerning the exercise of the right to cancel before the cancellation period has expired.

11.5  If you withdraw or cancel the services, on the basis described in this Section 11, you will receive a full refund of any amount you paid to us except as specified in this Section 11. Please be advised that you may be charged for some fees such as PayPal transaction for service cancellation if applies.

11.6  We will refund money using the same method used to make the payment, unless you have expressly agreed otherwise. In any case, you will not incur any fees as a result of the refund except the fees referred to in Section 11.5.

11.7  We will process the refund due to you as a result of a cancellation on the basis described in this Section 11 without undue delay and, in any case, within the period of 14 days after the day on which we are informed of the cancellation.

12.    Your content: licence

12.1  In these terms and conditions, "your content" means all works and materials (including without limitation text, graphics, images, audio material, video material, audio-visual material, scripts, software and files) that you submit to us or our website for storage or publication on, processing by, or transmission via, our website.

12.2  You grant to us a worldwide, irrevocable, non-exclusive, royalty-free licence to reproduce, store and publish your content on and in relation to this website and any successor website.

12.3  You grant to us the right to sub-license the rights licensed under Section 12.2.

12.4  You grant to us the right to bring an action for infringement of the rights licensed under Section 12.2.

12.5  You hereby waive all your moral rights in your content to the maximum extent permitted by applicable law; and you warrant and represent that all other moral rights in your content have been waived to the maximum extent permitted by applicable law.

12.6  You may edit your content to the extent permitted using the editing functionality made available on our website.

12.7  Without prejudice to our other rights under these terms and conditions, if you breach any provision of these terms and conditions in any way, or if we reasonably suspect that you have breached these terms and conditions in any way, we may delete, unpublish or edit any or all of your content.

13.1  You warrant and represent that your content will comply with these terms and conditions.

1.    How can I sign up?

In the first instance you can either register a new account with us, or sign in using your Facebook details. Once you have your user ID and password, you need to verify your business by clicking the verification tab. If your business is already registered with local authorities, your business information will be created automatically.

 

If you have failed verification, you need to contact your local authority by email for more information.   

 

2.    How can I create business profile?

You can update and edit your business information at My Page after logging in. All services are free with the exception of the specific business promotions we offer. Feel free to change and update your business information as frequently as you like.  

 

3.    How can I edit our business information?

Log in to the site using your User ID and password then go to edit business profile under My page. You can upload your business logo and contact information here. Also, to post your business product & services, unpdate company information and staff, you can create and update all this by clicking the columns under MEMBERS. All you need to do is to follow the step by step process on screen.

 

4.    I want to promote our goods. What should I do?

Promoting your products and services is one of the key ways to increase your sales. Our online promotions are designed to promote your goods and services to other local business, allowing an increase in both sales and awareness of your business.  The promotional costs have been kept to an absolute minimum to allow business the opportunity to take advantage of this direct marketing opportunity.

 

All the various options are listed on screen.  Follow the step by step guide to list your promotions and offer.  We recommend a promotion is run for a maximum of 6 months.  For long term promotions we offer discounted prices. For more services and information, please go to My payment after sign in.

 

5.    How can I create promotion?

Promotion is a paid service and you will need to pay in advance before your promotion goes live. Log in to your account and go to My payment and choose one of the services listed. When you complete the payment, you will see Promotion list you bought at Manage my products under PROMOTION. Click the promotion number and start filling out the information to create your own advertisement.

 

6.    I don't want my promotion to be published any more. What should I do?

Go to Manage my products and click the Promotion number you don't want to post any more. Then click OFF from 'Display Status at Promotion'. The posting will disappear from the Promotion and people can't see it any more.

 

7.    How can I create employees information?

Having staff contact information is the most communicative way to interact with your customers. Go to Edit staff under MEMBERS and click create a new employee then fill out the information you want to post.   

 

8.    How can I delete staff information?

Go to edit staff and click the NAME of staff you want to delete. You will see the staff information below. Then click Delete.

                                                                   

9.    I am a self-employed and have no employees at this moment. What should I do?

Leave the employees blank. You don't have to create the information if you don't have information to upload.  Don't forget to make sure your personal information is correct.

 

10. I don't have a PayPal account. Can I use my credit card to pay Netalkers?

Yes you can, however this is facilitated via PayPal. All payment method will be only what is accepted via PayPal and their facilities.

 

11. I want to register for an event to attend. How can I do that?

Please click the Event from one of the top bar menus, then click the event you want to attend. You will see “Join the event” from Attendee List. At the Join the event you can manage who will attend the event. However, please remember that you need to create you and your staff information first to join the event.

 

12. I want to receive updates on events, but not promotions. How can I change that?

You can manage your email settings based on what you want. Go to OPTION under My page. Click Email settings and manage the mail list to whatever you would like to receive information for. For your information, Promotion and Community is set as default but you can change them here.

 

13. I am a local resident, not a business owner. Can I use the services?

Of course, but listing are limited to businesses. You can check and search for local business information and community updates after sign up.

 

14.  I run a business in other region. Can I use the services?

Businesses registered with a Local Authorities are eligible to use the services. However, you can use the services as a guest member as long as the Local Authority approves. Each Local Authority has its own regulations so please contact the manger for more information.

 

15. I would like to refund. What should I do?

16. I would like to leave the services. What should I do?
